The Civil Procedure rules say parties should try and mediate before they litigate.

The Civil Procedure rules sat that court proceedings should be a last resort.

The court will ask the parties to justify why they are unwilling to mediate.

The court is unlikely to award costs to a winning party if the judge decides that they unreasonably refused to mediate and make them pay the losing party.
